On the 9th of July 2008 the Israeli Supreme Court rejected the petition by the residents of al-Nu`aman and accepted the State’s position. This means that 200 residents of the village will continue living in their houses without any formal legal status, surrounded by the separation fence and trapped in Jerusalem despite the majority of the residents being forbidden to move about the city.
In their appeal to the Court, the residents of al-Nu`aman requested that if there is no intention to move the separation fence, they should at least be allowed to apply for Jerusalem residency status to the Ministry of the Interior [collectively] as a village, rather than on an individual basis. The Court rejected this request, allowing them to apply on an individual basis only. The Court also noted that such residency is not equivalent to the status of East Jerusalem residents, due to the government decision of October 2007 that the authorization given to a person who demonstrates residency is temporary (i.e., requires renewal every so often) and will be valid only in the eastern part of the city.
